Chirag Rajendrakumar Shah Liquidator ... vs C. E. Fernandes
- CitationComp. App. (AT) (Ins) No. 894 of 2026
Ratio decidendi
The rule this decision rests on
The Tribunal disposes of the appeal by allowing the scheme proponent 30 days to deposit the sum of Rs. 37,00,00,000 with the Liquidator, to be held in an interest-bearing account; if deposited, the Stakeholder Consultation Committee is to consider the scheme and decide in accordance with law, and if not deposited, the Liquidator may proceed further in accordance with law. The order rests on the Adjudicating Authority's direction that the scheme be considered, with the deposit operating as the condition for that consideration, and does not state a general rule of law beyond this disposal.
