Competition Commission Of India15 October 2024

Ratio decidendi

The rule this decision rests on

A combination may be approved under section 31(1) of the Competition Act, 2002 where, having considered the material on record and the factors in section 20(4), the Commission is of the opinion that the combination is not likely to have an appreciable adverse effect on competition in India. Here, the parties' overlapping market shares were low, the vertical interface between insurance underwriting and insurance distribution was noted, and other competitors were present in each segment, so that opinion was formed. An approval under section 31(1) remains open to revocation if, at any time, the information furnished by the notifying party is found to be incorrect. Information furnished by the notifying party in the course of the notice is to be treated as confidential under section 57 of the Act.
