National Company Law Appellate Tribunal22 October 2024

Ratio decidendi

The rule this decision rests on

Where a company has been struck off the Register of Companies, and the striking off is shown to prejudice the interests of a shareholder in a pending proceeding, the Tribunal may set aside the striking off order on payment of costs and restore the company's name, so that the proceeding can continue and the merits remain open for adjudication before the NCLT.
