Bse Limited vs Oswal Yarns Limited

National Company Law Appellate Tribunal11 November 2022Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The Tribunal, following its earlier decision in Asahi Infrastructure & Projects Ltd. (Company Appeal (AT) (Ins.) No. 346 of 2019, dated 21.12.2021), holds that listing fees payable to a stock exchange fall within regulatory dues and are not operational debt, so they cannot be recovered through an application under Section 9 of the Insolvency and Bankruptcy Code, 2016.
