1.

We have perused the record. We find that the impugned order

was passed on January 28, 2022 and the penalty amount was paid 2

without protest on March 1, 2022. The present appeal has been filed

in order to get benefit under the Settlement Scheme.

2. Quite apart from this fact, we also find the appellant is not

entitled for the benefit of the Settlement Scheme as he has already

paid the amount under protest. The matter has reached a quietous.

Consequently, the appeal fails and is dismissed.

3. This order will be digitally signed by the Private Secretary on

behalf of the bench and all concerned parties are directed to act on

the digitally signed copy of this order. Certified copy of this order is

also available from the Registry on payment of usual charges.
