Azad Singh vs State Of U.P. Thru. Addl. Chief Secy. ...

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

Where an accused person has been in custody since 30.03.2026, has no criminal history, the complainant's statement recorded under Section 180 B.N.S.S. does not properly corroborate the prosecution case, and medical evidence shows injury consistent with the accused's version, the court may enlarge the accused on bail without entering into the merits of the case, subject to the satisfaction of the trial court regarding sureties and conditions.
