Avanish vs State Of U.P.

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

A bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 may be granted where, upon consideration of the totality of facts, nature of the offence, and the evidence on record, the court finds it to be a fit case for bail, without expressing any opinion on the merits of the case. A court granting bail may impose conditions including the furnishing of personal bond and sureties, and breach of such conditions shall constitute grounds for cancellation of bail. Any observations made by a court in a bail order are limited to the determination of the bail application and shall not be construed as an expression of opinion on the merits of the case, leaving the trial court free to arrive at independent conclusions on the basis of evidence led at trial.
