Ashish Kumar vs State Of U.P.

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

A person accused of an offence under the U.P. Gangster and Anti Social Activities Act, 1986 may be granted bail where: (i) there are only two base cases pending against him; (ii) he is currently on bail in those cases; (iii) he has no other criminal history; and (iv) he is not a previous convict. Where bail is granted, the court may impose conditions including execution of a personal bond and furnishing of sureties, and breach of such conditions renders the bail liable to cancellation by the trial court.
