Asgi Properties Private Limited vs Rajesh Ramnani& Anr

National Company Law Appellate Tribunal11 December 2024Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The Adjudicating Authority does not err in rejecting an application seeking directions to renew an expired building map approval and to complete external infrastructure work where the approval has already lapsed and renewal proceedings before the municipal authority remain pending; in such circumstances the relief sought is not available from the Adjudicating Authority at this stage. Where a Resolution Plan has been submitted and approved and is pending consideration before the Adjudicating Authority, the appellant's remedy in respect of any subsequent renewal or revalidation of the plans by the development authority lies in the liberty to pursue such remedy as is available in law, and no direction on that question is given at this stage.
