Anurag Kumar Sinha vs Rajmal Mangilal Jain

National Company Law Appellate Tribunal25 November 2025

Ratio decidendi

The rule this decision rests on

Where an applicant seeks condonation of a refiling delay in an insolvency appeal, the explanation offered must be satisfactory for the delay to be condoned; a bare account of misplacement of the case file by the applicant's advocate's clerk, traced months later, which does not explain the inordinate delay of 274 days, is not such an explanation, and the application for condonation of delay is rejected together with the memo of appeal.

3. We do not find any satisfactorily explanation for inordinate delay of 274

days in refiling the appeal in the above paragraphs. Appeal arises out of

proceedings under insolvency and there being no satisfactorily explanation in

the application, we are unable to condone the delay as prayed for therefore IA
