- Neutral2026:AHC:104859
Ratio decidendi
The rule this decision rests on
When an accused charged with offences under Sections 406, 419, 420, 471, 467, and 468 IPC is before the court in a bail application during trial, the court may grant bail having regard to the nature of the offence, the evidence against the accused, the degree of complicity, the condition of overcrowded jails, the heavy pendency of criminal cases before trial courts, and the principles laid down by the Apex Court regarding bail, without expressing any opinion on the merits of the case. Where bail is granted, the applicant shall be released on furnishing a personal bond and two sureties each in an amount fixed by the court, subject to conditions including verification of identity, status and residence proof of the applicant and sureties, verification of mobile number and Aadhaar card details, and compliance with such other conditions as the court may impose. Breach of any condition imposed upon the grant of bail shall be a ground for cancellation of bail. A trial court shall accept release on the basis of a computer-generated copy of the bail order downloaded from the official website of the High Court and verified by the concerned counsel, with an undertaking that the certified copy will be filed within fifteen days. The trial court shall transmit the release order to the concerned jail through the Bail Order Management System (BOMS) to ensure expeditious release of the applicant.
