- Neutral2026:AHC:106005
Ratio decidendi
The rule this decision rests on
Where a bail applicant is similarly situated to a co-accused already enlarged on bail, and considering the nature of the offence, the evidence, the complicity of the accused, the overcrowding of jails, and the heavy pendency of criminal cases before trial courts, bail may be granted even during the pendency of trial, without expressing any opinion on the merits of the case. The conditions for grant of bail include that the applicant furnish a personal bond and two sureties in like amount; that identity, status and residence of the applicant and sureties be verified by the trial court before bonds are accepted; that mobile number and Aadhaar card of the applicant and sureties be verified by the trial court; that breach of conditions of bail shall be grounds for cancellation; and that the trial court shall communicate the release order to the concerned jail through the Bail Order Management System to ensure early release.
