National Company Law Appellate Tribunal15 September 2025Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The Appellate Tribunal disposed of the appeal without deciding any question of law on the merits. Where the corporate debtor's default is settled, the appeal against admission under section 9 may be disposed of as no purpose would be served by keeping it pending, and further steps in the CIRP are to await the Adjudicating Authority's decision on the operational creditor's application under section 12A, with the IRP continuing to act with the assistance of the corporate debtor's officials and employees.
