- Neutral2026:AHC:103474
Ratio decidendi
The rule this decision rests on
A bail application in a case involving serious offences (murder, dacoity, and criminal conspiracy under Sections 302, 394, 411, 120B and 34 IPC) may be granted where the court considers the nature of the offence, the evidence against the accused, the accused's complicity, the overcrowded condition of jails, and the heavy pendency of criminal cases before trial courts, applying the principles laid down by the Supreme Court regarding bail jurisprudence. The conditions for grant of bail include: furnishing of a personal bond and two sureties in equal amounts to the satisfaction of the court; verification of identity, status and residence proof of the applicant and sureties by the court before bonds are accepted; verification of mobile number and Aadhaar card of the applicant and sureties; and compliance with such conditions as may be imposed, breach of which shall be grounds for cancellation of bail. An applicant may be released on bail on the basis of a computer-generated copy of the bail order downloaded from the official website of the High Court and verified by counsel, with an undertaking to file the certified copy within fifteen days. The trial court shall transmit the release order to the jail through the Bail Order Management System to ensure expeditious release of the applicant. The trial court shall expedite the conclusion of trial, utilizing video conferencing facilities for witness examination if necessary.
