Acalmar Oils & Fats Ltd vs Commissioner Of Central Excise, And ...

Customs Excise and Service Tax Appellate Tribunal20 March 2015

Ratio decidendi

The rule this decision rests on

The Tribunal may condone a short delay of 6 to 8 days in filing an appeal before the first appellate authority where the explanation offered, that the period of limitation was miscalculated, is accepted as sufficient in the interest of justice, and the matter is accordingly remanded to the Commissioner (Appeals) for decision on merits with the delay treated as condoned.

HON'BLE Mr. B.S.V. MURTHY, TECHNICAL MEMBER

Final Order Nos. 20802-20803 / 2015

Per : B.S.V. MURTHY

Both the appeals have been rejected on the ground that the delay of 6 to 8 days has not been explained to the satisfaction of the Commissioner (Appeals). In the petition filed for condonation of delay, it was the submission of the appellant that they had miss-calculated the period of limitation.

2. I find that the delay is only 6 to 8 days and in the interest of justice it could have been condoned by the Commissioner. Accordingly the delay is condoned and the matters are remanded to the learned Commissioner (Appeals) and decided on merits treating the delay as condoned. (Order dictated and pronounced in open court)

(B.S.V. MURTHY) TECHNICAL MEMBER
