Aar Kay Industries (Prop. Indian ... vs Jatalia Global Ventures Limited

National Company Law Appellate Tribunal21 December 2023Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The Tribunal reasoned that, in an appeal against rejection of a Section 7 application on limitation grounds, documents not placed before the Adjudicating Authority may be taken on record by the appellate body, and that where the Adjudicating Authority's order rests on an incomplete record, the matter is to be remitted for fresh consideration on the full material rather than decided on the appellate record alone.

the application or filed additional documents. It is true that those documents

which have been now filed were not filed before the Adjudicating Authority but

we in the appeal also, there is no prohibition in accepting those documents. We

take these documents on the record.

served in remitting the matter before the Adjudicating Authority for passing a

fresh order, after considering the materials which are brought by both the

parties on record.
