Ratio decidendi

The rule this decision rests on

This is a compounding order under Section 15(1) of FEMA, and the reasoning is present in the text, so a ratio is stated below. The contraventions of paragraph 9(1)(A) and paragraph 9(1)(B) of Schedule 1 to Notification No. FEMA.20/2000-RB, being delay in reporting receipt of foreign inward remittances for share subscription and delay in submitting Form FC-GPR after issue of shares to a non-resident, are established on the admitted facts, and the applicant's failure to attend the hearing does not prevent the application being decided on the documents filed. Under Section 13 of FEMA, a contravention attracts penalty of up to thrice the sum involved upon adjudication, but the authority may, in the exercise of its discretion under Section 15(1), compound such a contravention on payment of a sum fixed having regard to the relevant facts and circumstances of the case, and where the sum so fixed is considered to meet the ends of justice, the admitted contraventions stand compounded and the application is disposed of accordingly.
