Sai Krishna vs Malabar Hotels Pvt. Ltd. & Anr

National Company Law Appellate Tribunal28 August 2018

Ratio decidendi

The rule this decision rests on

The Resolution Professional's affidavit shows the resolution plan has already been approved and more than 270 days have elapsed, and an applicant who has not deposited the earnest money within the time allowed cannot be admitted into the resolution process at such a belated stage; the appeal is therefore dismissed.
