Pratosh Kumar Sharma vs M/S Bhanvi Buildtech Pvt. Ltd. & Ors

National Company Law Appellate Tribunal16 November 2016

Ratio decidendi

The rule this decision rests on

The Tribunal's direction that the interim administrator take custody of the company's assets and properties is not necessary for the purpose of submitting a report on the company's affairs; a direction to take interim custody of the books of account, vouchers and papers is justified for that purpose, and the direction over the assets and properties is set aside. Pending final adjudication, any sale, mortgage, alienation or encumbrance of the company's assets by the management must be intimated to the interim administrator and the respondents, with receipts recorded in the books of account and deposited in the company's bank account. Observations made prima facie by the Tribunal in the impugned order are not to be relied upon by any party or by the Tribunal at the final hearing, and the company petition must be decided on the merits on the evidence on record and the administrator's report.
