Pradeep Kumar vs Rakesh Kumar Jindal

National Company Law Appellate Tribunal25 November 2024Ashok Bhushan

Ratio decidendi

The rule this decision rests on

Where the appellant himself asserts in the appeal that an OTS proposal has been submitted, the question of debt and default does not survive for consideration, so the appeal against admission under Section 7 cannot be sustained on that ground. Once the Committee of Creditors has been constituted in the CIRP, closure of the process on the basis of a settlement must proceed through an application under Section 12A read with Regulation 30A before the Adjudicating Authority, and the settlement proposal must first be placed before the CoC and approved by the requisite voting share of 90%.
