Ratio decidendi
The rule this decision rests on
The compounding authority holds that, where the applicant has made a full and truthful declaration on its compounding application that it is not under any enquiry, investigation or adjudication and has not filed any appeal under sections 17 or 19 of FEMA, the contraventions may be compounded on that basis, subject to the veracity of those declarations; if they are later found to be false or incorrect, the order is without prejudice to any other action under the extant laws. Under Section 13 of FEMA, a contravening person is liable to a penalty of up to thrice the sum involved upon adjudication; the authority may nonetheless, having regard to the relevant facts and circumstances of the case, take a lenient view and fix a compounding amount that it considers meets the ends of justice, and it holds that a fixed sum of ₹97,500 suffices in the present case.
