The rule this decision rests on
The Regional Director may compound admitted contraventions of FEMA under Section 15(1) on an application made by the contravening party, by assessing the amount involved in each contravention and levying a compounding sum in lieu of adjudication, where the applicant admits the contraventions and has been given an opportunity to be heard. A contravention of the time limits prescribed by the Foreign Exchange Management (Transfer or Issue of Security by a Person Resident outside India) Regulations, 2000 (paragraphs 8, 9(1)(A) and 9(1)(B) of Schedule 1 to Notification No. FEMA 20/2000-RB) is established where shares are not allotted within 180 days of receipt of inward remittance, where receipt of remittance is not reported within 30 days, or where Form FC-GPR is not filed within 30 days of allotment, and each such late act constitutes a separate contravention measured by the period of delay and the amount involved.

(b) The applicant vide letter dated January 20, 2017 informed that they opt out from the personal hearing in deference to the RBI statement made under Press Release dated January 18, 2013 and requested to consider the application leniently.
4. I have given my careful consideration to the documents on record and submission made by the applicant during the personal hearing. Accordingly, I hold that the applicant has contravened the following FEMA provisions issued in terms of: (a) Paragraph 8 of Schedule 1 to Notification No. FEMA 20/2000-RB for delay in allotment of shares beyond the stipulated period of 180 days from the date of receipt of foreign inward remittances. The contravention relates to an amount of ` 3,08,650/- and the period of contravention is 3 days approximately. 5. In terms of Section 13 of the FEMA, any person contravening any provision of the Act shall be liable to a penalty upto thrice the sum involved in such contravention upon adjudication. However, taking into account the relevant facts and circumstances of the case as stated in the foregoing paragraphs, I am persuaded to take a lenient view on the FED M/s. Nuevo Renewable Power Pvt. Ltd CA No. HYD 185 amount for which the contravention is to be compounded and I consider that an amount of `87,337/-(Rupees Eighty Seven Thousand Three Hundred Thirty Seven Only) will meet the ends of justice. 6. Accordingly, I compound the admitted contraventions namely, the contraventions of Paragraph 8, Paragraph 9 (1) (A) and Paragraph 9 (1) (B) of Schedule 1 to Notification No. FEMA-20/2000-RB by the applicant on the facts discussed above in terms of the Foreign Exchange (Compounding Proceedings) Rules, 2000 on payment of an amount of `87,337/- (Rupees Eighty Seven Thousand Three Hundred Thirty Seven Only) which shall be deposited by the applicant with the Reserve Bank of India, Foreign Exchange Department, 1st Floor, Saifabad, Hyderabad - 500004 by a demand draft drawn in favour of the "Reserve Bank of India" and payable at Hyderabad within a period of 15 days from the date of this order.
