Ms. Shweta Garodia vs Sebi

Securities Appellate Tribunal11 October 2022

Ratio decidendi

The rule this decision rests on

The appeal is disposed of on the footing that it falls within the SEBI Settlement Scheme, 2022 made under Regulation 26 of the Securities and Exchange Board of India (Settlement Proceedings) Regulations, 2018, and is governed by this Tribunal's earlier decision in Dhanwantri Suppliers Pvt. Ltd. v. SEBI, so that a matter of this category pending in appeal is to be resolved through the settlement mechanism rather than adjudicated on its merits. Where the appellant files a settlement application before the competent authority within the time fixed, that application is to be treated as one filed in a pending proceeding and accepted under the Settlement Scheme, with the authority required to pass appropriate orders on it. A delay in filing an appeal is condoned where the reasons stated in the accompanying application justify it, and the connected applications for condonation of delay and exemption are allowed on that basis.
