Mitesh Anilkumar Agarwal & Ors vs Rajeev Dhingra

National Company Law Appellate Tribunal22 November 2023Ashok Bhushan

Ratio decidendi

The rule this decision rests on

In the ends of justice, where a respondent to an avoidance application has already filed a reply along with its application to recall an ex-parte order, the Adjudicating Authority may direct that such reply be taken on record and treated as the reply to the avoidance application, rather than rejecting it, so that the application may be considered on its merits along with that reply.
