National Company Law Appellate Tribunal25 October 2021

Ratio decidendi

The rule this decision rests on

The impugned order of the Adjudicating Authority, passed without notice to the appellant or an opportunity of hearing, cannot stand; a Committee of Creditors member is not thereby excused from being given notice and a reasonable opportunity of hearing before an application affecting its rights is decided, and the matter is remitted for fresh decision after affording such an opportunity.
