4. The Acquirer in its aabboovvee mmeennttiioonneedd response dated 14th FFeebbrruuaarryy, 22002200 also submitted cceerrttaaiinn aaddddiittiioonnaall iinnffoorrmmaattiioonn under Regulation 16(1) of the CCoommbbiinnaattiioonn RReegguullaattiioonnss.

5. Greenko, iinnccoorrppoorraatteedd iinn MMaauurriittiiuuss, is a wholly-oowwnneedd ssuubbssiiddiiaarryy ooff GGrreeeennkkoo EEnneerrggyy Holdings (“GEH”).. GGrreeeennkkoo hhaass iinnvveessttmmeennttss iinn aa ppoorrttffoolliioo ooff ccoommppaanniieess eennggaaggeedd iinn pppooowwweeerrr gggeeennneeerrraaatttiiiooonnn ttthhhaaattt ooopppeeerrraaattteee sssooolllaaarrr, hhhyyydddrrrooopppooowwweeerrr, wwwiiinnnddd, bbbiiiooommmaaassssss, aaannnddd gggaaasss ppplllaaannntttsss iiinnn IIInnndddiiiaaa... It operates various pprroojjeecctts under the names, i.e. Grreeeennkkoo, OOrraannggee, SSkkeeiirroonn aanndd SunEdison in India.

BBaasseedd oonn tthhee ssuubbmmiissssiioonnss, iitt iiss oobbsseerrvveedd tthhaatt tthe Parties exhibit hhoorriizzoonnttaall oovveerrllaappss at the broader level ooff ttoottaall ppoowweerr ggeenneerraattiioonn iinn IInnddiiaa and at a nnaarrrrooww lleevveell in (i) all ssoouurrcceess ffoorr ppoowweerr ggeenneerraattiioonn except Reenneewwaabbllee EEnneerrggyy SSoouurrcceess ((““RES”) (which includes thermal, nnuucclleeaarr and large hydro projects5) [“sub-sseeggmmeenntt 11”] and (ii) hydro power generation (oonnllyy llaarrggee hydro projects) [“sub-segment 2”]. IItt wwaass ssuubbmmiitttteedd tthhaatt small hydro power pprroojjeeccttss (upto installed capacity of 25 MW) aarree ccaatteeggoorriizzeedd under RES bbyy CCeennttrraall EElleeccttrriicciittyy AAuutthhoorriittyy ((““CEA”).
