Ratio decidendi
The rule this decision rests on
The Reserve Bank, in compounding proceedings under Section 15(1) of FEMA, may dispose of an application on the basis of the averments and submissions made in it where the applicant has been given an opportunity of personal hearing and has declined to attend, requesting disposal on the merits of the written application. Where the applicant admits the contraventions and makes the declarations required by the compounding scheme, the authority may compound the admitted contraventions on payment of a compounding amount fixed by it, having regard to the relevant facts and circumstances and taking a lenient view of the maximum penalty otherwise leviable under Section 13 of FEMA. Compounding under the Foreign Exchange (Compounding Proceedings) Rules, 2000 is subject to the veracity of the applicant's declarations, and the order is without prejudice to any other action under the extant laws should those declarations later be found false or incorrect.
