Competition Commission Of India25 August 2026

Ratio decidendi

The rule this decision rests on

Where the parties' combined market share in the broad market and in each narrow segment falls within the 0–5% range, and the parties have no existing or potential vertical or complementary linkages, the Commission may conclude that a combination is not likely to cause an appreciable adverse effect on competition without finally delineating the relevant market. A combination is not likely to cause an appreciable adverse effect on competition, and is approved under Section 31(1), where the Commission, on the material on record including the notice and the acquirer's responses to its information requests, has assessed the combination against the factors in Section 20(4) and found no such likely effect.
